Proposed changes to the CON29 and CON29O enquiry forms

Proposed changes to the Con29 and Con29O enquiry forms are being consulted, according to the Law Society.

With buyers looking at cheaper house prices, it's still vital that they know the right information about a property before committing to buy. Searches carried out against the property will provide information about its location, construction and any problems in the surrounding area which may affect the property i.e flooding areas and contaminated land.

Records held by Local Authorities can be a vital part of the conveyancing process. The Con29 forms act as a list of standardised questions that the solicitor can request from local authorities. The CON29O forms which are optional are used to ask for additional questions that wouldn't necessarily be mentioned in the standard LLC1 and CON29R search.

Some of the proposed changes to the CON29 and CON29O forms will include questions relating to:

  • Assets of Community Value
  • The Green Deal
  • High Speed 1 or High Speed 2 railways
  • Flood and coastal erosion risk management
  • The community infrastructure levy
  • Traffic Schemes

Current negotiations regarding the changes are underway between the Local Land Charges Institute and Local Government Association. The consultation will close on 1 August 2013.

You can read about the full consultation here and download the results of the drafted revised forms from the Law Society's website.
