Anyone can make a Will as long as they are over 18 and capable of writing one. It must be made in writing with two witnesses present at the signing and who aren't beneficiaries of the Will. If the Will isn't properly witnessed, it will remain invalid and the deceased person's property will be distributed in accordance with intestacy rules.

 

Intestacy rules state that if you are married, your spouse or partner is the first person entitled to your estate, however you should be aware that they will not necessarily inherit the whole of your estate. This depends on how much it is worth and how many of your relatives survive. Any belongings or money held in joint names will be passed to the other joint owner.

 

What you should consider when making a Will.

 

  1. If you are thinking of writing a Will, ensure you consider taking legal advice discussing your wishes with a solicitor before you doing it yourself. If there are any mistakes, this can cause a lot of difficulties for your spouse and family.
     
  2. Many folk are finding it easy to search on the internet to organise a Will. Our suggestion would always be to get a solicitor to proof it afterwards.
     
  3. Once your Will is finalised, and the witnesses have signed the declaration, make sure the Will is kept somewhere that your executors are aware of and get can access to.
