Grievance procedure solicitors

What is a "grievance procedure" and can our Tunbridge Wells Solicitors help?

A grievance procedure is usually put in place by an employer to help employees to deal with any grievances relating to their employment fairly and without unreasonable delay.

It should not be used to complain about dismissal or disciplinary action, which should be dealt with under a disciplinary procedure.

In outline, an investigation will be carried out and a meeting will be held with the employee to discuss the grievance.  After the meeting the employer will inform the employee in writing of the outcome, and give them the right of appeal.

Issues that may cause grievances include:-

Terms and conditions of employment

Health and safety

Discrimination

New working practices

Bullying and harassment

Work relations

Working practices

Many grievances can be resolved quickly and informally through discussion with a line manager or a member of the HR department.

If that isn't possible, a formal written grievance should be submitted.  It should contain a full description of the nature of the complaint, including any relevant facts, dates and names of individuals involved.

We can advise employees on all aspects of the grievance procedure, regardless of the nature of the complaint. If appropriate, we can help you raise the issue of a compromise agreement with your employer, in the event that you decide you would prefer to terminate your employment during the course of the grievance proceedings.

If your complaint is particularly serious, raising a grievance and trying to resolve it with your employer can be an important step prior to resigning and claiming constructive dismissal at an Employment Tribunal.  We can help advise you on the crucial steps along the way, including the submission of your written grievance and written appeal.

As an employer, dealing with a formal grievance raised by an employee should be done with reference to your grievance procedure and the ACAS (Arbitration, Conciliation & Arbitration Service) Code of Practice

A key requirement for an employer is to act fairly and reasonably within the meaning of the law, and to follow the correct procedures at all times.  This is not easy to do without the help of a specialist employment solicitor, which is where our solicitors can help.

We can draft or update your grievance procedure, and advise on its application in practice with regard to specific situations with your employees.
