Struck Off Solicitors Get Second Hearing

A Solicitors Disciplinary Tribunal has been forced to give a pair of city lawyers a second hearing by a High Court Judge.

 

Former partner at Stewarts Law, Andrew Shaw and his colleague Craig Turnbull a former solicitor at the firm were initially ordered to be struck off at the hearing held last February. 

 

However, following a subsequent High Court hearing last month lasting four days, a judge ruled that the duo's case should be heard again.

 

Solicitors Shaw and Turnbull were charged with dishonesty among other accusations by Geoffrey Logue, a businessman who was litigated against by a client of the firm Stewarts.  As reported in the Law Society Gazette, they denied the charges.

 

Grounds for Shaw and Turnbull's appeal centred on the grounds that 'the SDT had failed to properly apply the correct test of dishonesty and failed to properly set out its reasons and reasoning process.'  The pair also believe the hearing was conducted in an unfair manner.

 

Mr Justice Jay noted that the SDT's findings were 'inadequately reasoned' resulting in Shaw and Turnbull getting a second hearing of their case when the sanction ruled against them will be looked at again.
