Child refused criminal injury compensation

A child who suffers with learning, development, behavioural and memory problems due to her mother's excessive drinking in pregnancy is not entitled to criminal injuries compensation, a judge has ruled.

 

The action was brought by a council in the North West of England, which had fought for compensation on behalf of the child, now seven years old.

 

Three judges unanimously ruled that the mother, who drank half a bottle of vodka and eight cans of strong lager a day while pregnant, was not guilty of a criminal offence under British law.

 

The British Pregnancy Advisory Service (Bpas) and Birthrights welcomed the verdict, saying that the case could have led to pregnant womens' behaviour being criminalised.

 

Bpas said it was an "extremely important" ruling for women who must be able to "make their own decisions about their pregnancies."
