Litigation Terrorism and the Press

One of the founding articles of the Magna Carter was the principle, "to no one will we sell, to no one deny or delay right or justice".

 

In a recent article written for the Telegraph website the suggestion is that a state of "litigation terrorism" currently exists.

 

The concept is that an individual hires a "smart firm of libel lawyers" charging in excess of £500 per hour, or more, and the threat of a huge bill forces a newspaper, or other entity, to agree a settlement.

 

The suggestion is that a newspaper (s) may seek a settlement rather than pursue a case where the risk of losing would incur significant costs. 

 

Justice should not be bought or sold, the article says, but as a society we seemingly struggle to accept this principle as certain lawyers charge far more than ordinary people can afford to pay.

 

Additionally these unaffordable legal costs are being used as a weapon between politicians and the media over press regulation.

 

The point of the article being that the law should be affordable to all and not used as a bullying tactic towards others.
