Medical Negligence Claims a Threat to NHS

A senior business figure from Whitehall has commented that the huge payouts for medical negligence claims are posing a threat to the National Health Service (NHS), with £1.6 billion paid out last year alone.


Questions have been raised as to whether patients should lose their right to sue for medical negligence, with the number of claims rising by almost 18% in the year from March 2013. Jeremy Hunt, the health secretary, will tomorrow be announcing financial sanctions for hospitals that fail to own up to their clinical errors, in a growing industry of compensation claims.


Hospitals that cannot provide evidence of being open about a mistake that lead to medical negligence could be asked to pay up to £10,000 to the NHS Litigation Authority for each case. The NHS Litigation Authority, which provides indemnity cover for legal claims against the health service, has set aside £2.1 billion to cover outstanding liabilities; a quarter of the annual health budget at £133 billion.


Michael Wade, a former Lloyd's of London insurance executive turned government adviser, said:


"I'm not saying there shouldn't be a duty of care, because of course there should be, but at what point do we say, 'No, I'm sorry, the statutory law says you can't sue'?"
