Watchdog bans negligence TV ad

Watchdogs have banned a Medical Negligence advert after complaints it was offensive.

The TV advertisement made by Liverpool firm Michael W Halsall, who trade as claimthroughus.com, have been ordered by The Advertising Standards Authority (ASA) to take down the ad.

The advert introduced a diagram of a pregnant lady with labels surrounding her saying 'forceps injury' and 'cerebral palsy'. An image of a doctor inside an orange warning triangle was then shown.

Dramatic music was played with a voiceover which said, "During pregnancy you thought your doctor was doing everything they could for you and your baby….. But your doctor didn't see the danger signs, and now you're left picking up the pieces."

15 complaints were received from expectant mothers who said the ad may offend pregnant woman and those who have suffered from problems during birth.

The ASA said the ad had broken the rules as it had caused offence to pregnant women.

Michael W Halsall Solicitors said, "The firm engaged the Media Agency Group approximately 10 months ago to design and deliver a media campaign to promote the Claimsthroughus.com brand, specifically in relation to clinical negligence claims. Once the campaign had been designed all of the adverts were then ratified by 'Clearcast' who approved both the scripts and also the final commercials prior to them being broadcast. Clearcast were satisfied that the commercials complied with the BCAP code (rules) that applies to television advertising, such as good taste and decency criteria."
